Last Will and Testament of John McGlade

John McGlade died at Perth, Lanark Co., Ontario on 27 September 1891. His last will and testament was signed and witnessed on 20 September 1889; and was registered 5 October 1891.1

Last Will and Testament of John McGlade

This is the last will and testament of one John McGlade of the Town of Perth in the County of Lanark and Province of Ontario, Carter.

(1st)    I give and devise to my daughter Elizabeth Burns of the said Town of Perth, — wife of John Burns of the same place, Laborer, All and singular that certain parcel or tract of land and premises situate lying and being in the said Town of Perth, and being composed of a part of Lot Number Six on the South side of Harvey Street in the said Town of Perth, — described as follows. Commencing on the West side of Beckwith Street at a point forty feet from the Corner of Harvey and Beckwith Streets, then South-Westerly parallel to Harvey Streets, Eighty-feet, then South-Easterly parallel to Beckwith Street forty-feet, then South-Easterly along the north-side of Harvey Street, Eighty-feet to Beckwith Street, then North-Westerly along the West side of Beckwith Street forty feet to the place of beginning.To Have and to Hold the same to her her heirs and Assignees forever, but subject nevertheless to the payment by her the said Elizabeth Burns of a Mortgage upon said Lot at present due to one Thomas McKinley in the sum of Two hundred dollars.

(2nd) I give and devise unto my beloved wife Angelina McGlade all and singular that certain parcel or tract of land and premises situate lying and being in the said town of Perth and Being composed of a part of Lot number six on the south side of D’Watteville street then south westerly parallel to D’Watteville street one hundred and ninety one feet more or less to a post planted, then south Easterly along the rear of said Lot fifty feet to a post planted then North Easterly parallel to D’Watteville street one hundred and ninety one feet to a post planted on the West side of Beckwith street then North Westerly along the Beckwith street fifty feet to the place of beginning. To have and to hold the same to her during the term of her natural life the devises and bequests in this my will made to my said wife to be in lieu of all dower or claim for dower by her on my estate.

(3rd) After the death of my said wife, I give and devise the said land hereinbefore devised to my said wife for her life to my grandson Michael John English his heirs and assignees forever

(4th) It is my will that my son Arthur McGlade shall have the right and privilege for ten years after my death of entering upon the said land heretofore devised to my wife for life and afterwards to my said grandson and of taking therefrom for his own use and benefit all building sand which may be found thereon the said sand to be taken therefrom in the same way as I have been accustomed to take it off the adjoining Lot and so as to do no damage to the buildings at present erected thereon, the surface soil also to be filled in so as to leave the land level and in the same state as I have left the front of the adjoining lot number six on the North side of Harvey street.

(5th) I give and devise unto my son Arthur McGlade his heirs and assignees forever all the remainder of said lot number six on the north side of Harvey Street being that portion of said lot remaining after taking therefrom that part hereinbefore devised to my daughter Elizabeth Burns and also that part heretofore sold to my brother Michael McGlade this devise to my said son being subject however to the annuity to my said wife hereinafter mentioned

(6th) I give and devise unto my son Arthur McGlade his heirs and assigns forever my homestead being Lot number Five on the south side of Cockburn street in said town of Perth except that portion of said Lot heretofore sold to one Peter Quinn the Younger this devise to my said son being subject also to the annuity to my said wife hereinafter mentioned

(7th) I give and devise unto my said wife Angelina McGlade an annuity or yearly sum of One hundred dollars ($100.00) to be paid to her during the term of her natural life by my said son Arthur McGlade in quarterly payments of twenty five dollars each the first of such quarterly payments to become due and payable at the expiration of three months from the date of my death and I hereby charge the said annuity upon the lands hereinbefore devised to my said son Arthur McGlade and declare the same to be lien thereon

(8th) I give and bequeath unto my said wife Angelina McGlade all my household furniture including beds and bedding.

(9th) I give and bequeath unto my son Arthur McGlade my horse, cow, cart, wagon, harness, sleighs, and all my garden and agricultural implements

(10th) I give devise and bequeath unto my said son Arthur McGlade all the remainder of the real and personal estate of which I shall die possessed and not hereinbefore specifically disposed of and it is my will that my debts funeral and testamentary expenses shall be paid by my said son as soon after my decease as possible.

(11th) And whereas there is now existing a mortgage from my brother Michael McGlade to me for three hundred dollars said mortgage having been taken by me to secure the payment of a mortgage given by me on my said brothers account to one Henry Stone and on which there is owing a like amount I desire when my said brother shall have paid the said mortgage and interest and which is to be credited upon my said mortgage to Stone that my Executor hereinafter named shall give my said brother a proper discharge of my mortgage to Stone so that the land covered thereby shall be clear in the hands of my wife and grandson to whom it is hereinbefore devised. I hereby appoint William Welland Berford of Perth aforesaid Solicitor sole Executor of this my will. In witness whereof I have hereunto set my hand and seal this twentieth day of September in the year of Our Lord one thousand eight hundred and eighty nine.

County of Lanark, to wit} I Robert Stone of the town of Perth in the County of Lanark Bridge tender make oath and say that (1) that I knew John McGlade the testator in the will of which annexed is a true copy, (2) That the said John McGlade died at the said town of Perth on the 26th day of September last A.D. 1891, (3) that I this deponent and John W. McElligott of the said town of Perth shoemaker were present and
saw the said John McGlade sign and execute a paper writing as and for his last will and testament of which the annexed is a true copy, (4) That said will was executed at the said town of Perth and that I deponent and said John W. McElligott did subscribe our names as witnesses to said will at the request of the Testator in his presence and in the presence of each other
